Radio 4 heavyweights, John Humphrys and Jon Sopel joked about it and were sent to the BBC naughty corner.\u00a0 You and I are amazed that it\u2019s been the law for decades and yet, only now is it being properly addressed.<\/p>\n

Yes – it\u2019s good old equal pay and with this in mind we now have a further effort to drive greater equality in the workplace with the advent of\u00a0Gender Pay Reporting<\/strong>.\u00a0 Since April 4th 2018, organisations with over 250 employees have been bound by law to publish their gender pay gap data.\u00a0 So, what\u2019s the big deal?\u00a0 We SMEs are in the clear, aren\u2019t we?\u00a0 It\u2019s the big boys who are under the spotlight – not us.\u00a0 Hmmmm \u2026 don\u2019t be so sure.<\/p>\n

How it all started<\/strong><\/p>\n

Equal pay is nothing new.\u00a0 Following a number of industrial disputes in the late 1960s, most famously, the women machinists at Ford Dagenham, the Equal Pay Act was passed.\u00a0 In 2010, it was replaced by the Equality Act.\u00a0 For all this time, for a business to treat an employee less favourably in terms of pay or conditions, on the basis of gender, has been against the law.<\/p>\n

Over the past year, we\u2019ve seen numerous headlines, reporting high-profile allegations of discriminatory pay at some of the world\u2019s largest and best-known organisations, such as Google and the BBC.\u00a0 Now that the law demands that larger organisations publish their own gender pay gap, media attention isn\u2019t going to fade any time soon.<\/p>\n

Gender pay gap \u2013 what does it mean?<\/strong><\/p>\n

The gender pay gap is the average difference between the remuneration of men and women in a workplace. It often demonstrates a lack of equality of opportunity where most senior appointments are from one gender, even where the majority of employees are from the other gender, as demonstrated by some high-profile fashion retailers and airlines.<\/p>\n

According to\u00a0The Independent<\/a>, by April 4th, the deadline for reporting, of the companies who\u2019d published their details, 78% declared a gender pay gap.\u00a0 8% of companies reported zero pay gap and a surprising 14% reported a pay gap in favour of women.<\/p>\n

But I\u2019m just an SME.\u00a0 Surely I\u2019m in the clear.<\/strong><\/p>\n

Not so fast!\u00a0 Just because you don\u2019t have to publish your gender pay gap, doesn\u2019t mean you\u2019re not subject to consequences as a result of your actions.\u00a0 First of all – there are practical considerations –<\/p>\n

1.\u00a0Employee scrutiny<\/strong><\/p>\n

Increased media attention will inevitably lead to your staff taking an interest in your pay structure and who you employ in your higher paid positions.<\/p>\n

2.\u00a0Being an attractive employer<\/strong><\/p>\n

Employees are your most valuable asset.\u00a0 Be sure that you attract the very best.\u00a0 You need to be able to show that you are an objective employer, that you take seriously issues such as diversity, flexible working and equal opportunities.<\/p>\n

3.\u00a0What if you plan to grow?<\/strong><\/p>\n

You may be an SME now.\u00a0 But if growth is in the pipeline, you might be hitting that 250 number sooner than you think.<\/p>\n

4.\u00a0The future?<\/strong><\/p>\n

It happened with pensions auto-enrolment.\u00a0 Why not with gender pay too?\u00a0 In other words, the pension regulations initially applied just to large firms, but they\u2019re for every employer.\u00a0 Might not every firm one day have to publish their gender pay gap?<\/p>\n

5.\u00a0Employment tribunal claims<\/strong><\/p>\n

Last July, the Supreme Court ruled that tribunal fees were unlawful.\u00a0 So, now employees will feel encouraged to make claims against employers.\u00a0 In fact, the average tribunal award for a sex discrimination case is almost \u00a320,000 – quite a potential dent to any SME\u2019s bottom line.<\/p>\n

Act now<\/strong><\/p>\n

Those were five practical reasons for making sure you comply with equality regulations.\u00a0 But of course, there are ethical ones too.\u00a0 Surely, we all want to do what\u2019s right?\u00a0\u00a0We all want our businesses to be successful and profitable but, of course, we want to achieve those goals by being fair to our customers and staff alike.<\/em><\/p>\n

Here a few steps you could take immediately to ensure you\u2019re being fair to your people.<\/p>\n

1.\u00a0Be clear about your position<\/strong><\/p>\n

Be sure you understand your current gender pay gap.\u00a0 Check your data, appreciate the reasons for any potential gender bias.\u00a0 Explore ways of addressing them.<\/p>\n

2.\u00a0Communicate your ethos<\/strong><\/p>\n

The responsibility for dealing with the gender pay gap lies ultimately with the management.\u00a0 Share your gender policy with your people.\u00a0 Let them know you take the issue seriously.\u00a0 Communicate your vision for gender equality in the<\/p>\n

workplace.\u00a0 Don\u2019t just focus on pay.\u00a0 Talk to your people about parental leave and flexible hours.\u00a0 Show that you care – about them.<\/p>\n

3.\u00a0Think about an open salary policy<\/strong><\/p>\n

Be transparent about what your people can expect to earn at each tier of the business<\/p>\n

4.\u00a0Lead by example<\/strong><\/p>\n

Thinking about positioning yourself ahead of the game.\u00a0 Don\u2019t follow your competitors.\u00a0 Be first.\u00a0 Lead the way by voluntarily publishing your gender pay gap data.\u00a0 This honest and open approach will show your employees (both prospective and current) that you are serious about gender equality.<\/p>\n

Be first and then \u2026 tell the world<\/strong><\/p>\n

Don\u2019t you find that one of the great benefits about being an SME is that you\u2019re often not tied down by bureaucracy or tradition?\u00a0 Be light on your feet.\u00a0 Be the stand-out gender equality business in your sector.\u00a0 Then make a fuss about it.\u00a0 Send out press releases.\u00a0 Get yourself on local radio.\u00a0 Be proud of the fact that you\u2019re up-to-date and that you care about being compliant and care about your people.<\/p>\n
